North Pattern Dakota Jury Instructions

North Dakota Pattern Jury Instructions, Civil and Criminal, are drafted by the Pattern Jury Instruction Commission under the authority of N.D. Supreme Court Administrative Rule 23.

Civil Instructions address: tort liability, wills and gifts, contracts, legal entities, damages, eminent domain, evidence, and closing instructions. They contain Verdict Forms and a table of Burden of Proof Requirements.

Criminal Instructions address: special situations, defenses, affirmative defenses, closing instructions, homicide, sex crimes, other personal crimes, robbery and crimes of trespass, damage to property, theft, and public crimes.  They contain a table of Burden of Proof Standards.

Both sets of instructions are annotated with statutes and cases the instructions are derived from and contain cross references to prior jury instruction versions.

They are updated as needed to reflect changes in the law and published in conjunction with the State Bar of North Dakota (SBAND), who places the PDFs on their website.

They are also available and searchable on Lexis Advance and Casemaker (all SBAND members have access to Casemaker as a benefit of membership.)

As they are updated, the Thormodsgard Law Library prints a copy that is kept on reserve.
