In her article, Professor Meyers depicts the significant conflict amongst divorce parents when their shared child has passed away post-divorce. This article provides an examination into the states who have a statute addressing priority amongst next of kin to determine duty of disposition and custody of remains. Moreover, this article examines states with a statute pertaining to dispute resolution amongst parents with equal standing as to disposition of remains. This article is beneficial to family law practitioners as it provides a succinct recommendation for pre-divorce negotiation and inclusion of language in settlement agreements to reduce the likelihood of parents finding themselves in conflict after the death of their minor child.
