North Dakota as of December had roughly 47 available workers for every 100 open jobs, according to data from the\u00a0<a href=\"https:\/\/www.uschamber.com\/workforce\/the-states-suffering-most-from-the-labor-shortage\" target=\"_blank\" rel=\"noopener\">U.S. Chamber of Commerce<\/a>\u00a0\u2014 the second-lowest rate of any state.<\/p>\n<p>Many North Dakota businesses are interested in filling open positions by hiring foreign workers on visas, but applying for them can be cumbersome. Hiring a private lawyer can be expensive, and there are only a\u00a0<a href=\"https:\/\/northdakotamonitor.com\/2026\/02\/06\/ice-detention-cases-begin-weaving-through-north-dakota-courts\/\">few full-time immigration attorneys<\/a>\u00a0in the state.<\/p>\n<p>Lawmakers thought the clinic could help a lot of workers through that process, said Rep. Mark Sanford, who sponsored the\u00a0<a href=\"https:\/\/ndlegis.gov\/assembly\/69-2025\/regular\/bill-overview\/bo1600.html?bill_year=2025&amp;bill_number=1600\" target=\"_blank\" rel=\"noopener\">2025 legislation<\/a>\u00a0that created the program.<\/p>\n<p>\u201cIt just seems logical to assist somebody who would want to come here,\u201d the Grand Forks Republican said.<\/p>\n<p>But since it opened in the fall, the University of North Dakota\u2019s Immigration Law Clinic has received very few inquiries about employment visas, said Director Erick Resek. He said this is likely due to recent changes to federal immigration policy, including the new\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/09\/restriction-on-entry-of-certain-nonimmigrant-workers\/\" target=\"_blank\" rel=\"noopener\">$100,000 filing fee for H-1B visas for skilled workers.<\/a>&nbsp;<\/p>\n<p>The program has instead focused on providing other legal services that help immigrants already in North Dakota enter the workforce, Resek said.<\/p>\n<p>Cristina Menendez, a third-year law student in the clinic, said her clients include two Venezuelan nationals seeking asylum and an immigrant seeking protection under the federal Violence Against Women Act.<\/p>\n<p>Menendez, whose family came to the U.S. from Cuba, has firsthand experience with the U.S. immigration system. She said one of the most rewarding aspects of working at the clinic has been helping break down communication barriers for Spanish-speaking clients.<\/p>\n<p>\u201cIt\u2019s very hard to find someone up here that can speak fluent Spanish and understand it,\u201d Menendez said.<\/p>\n<p>She said she hopes to one day open her own immigration law practice in North Dakota.<\/p>\n<p>Changes to the U.S. immigration policy under the Trump administration have presented unique challenges to the clinic, said RJ Tare, another third-year law student in the program.<\/p>\n<p>\u201cIt\u2019s been an adventure of unpredictability,\u201d he said. \u201cEvery day feels like, quite frankly, a new hurdle.\u201d<\/p>\n<p>He said several clients have been arrested by U.S. Immigration and Customs Enforcement, including asylum seekers.<\/p>\n<p>\u201cThey\u2019re trying to get a work permit, they\u2019re trying to build a life here,\u201d Tare, who immigrated to the U.S. from the Philippines, said. \u201cIt\u2019s really disheartening.\u201d<\/p>\n<p>The clinic has provided roughly 200 consultations and taken 20 clients, by Resek\u2019s estimate.\u00a0 He said the service has had to turn down most clients because there was no way to put them on a path toward employment, so they didn\u2019t fall under the purview of the program set in state law.<\/p>\n<p>\u201cEvery case I\u2019ve taken on at the clinic, I\u2019ve only taken it on if there was a possibility of getting someone employment authorization,\u201d he said.<\/p>\n<p>Resek said he and his students focus their resources on people who are \u201ctruly indigent,\u201d and they don\u2019t take on clients who have committed serious crimes.<\/p>\n<p>The Legislature has only approved two years\u2019 worth of funding for the clinic. Lawmakers during the 2027 session will have to decide whether to continue the program.<\/p>\n<p>The clinic received $400,000 for the 2025-2027 budget cycle.<\/p>\n<p>Sanford said given the unexpected circumstances facing the program, next year\u2019s Legislature may consider changing the scope of its work.<\/p>\n<p>\u201cThat is a fairly normal part of the process of legislation, that many times you have to come back and make an adjustment,\u201d Sanford said.<\/p>\n<h4 class=\"editorialSubhed\">Impacts to work visas<\/h4>\n<p>The federal government in September made H-1B visas \u2014 which are meant for skilled workers like nurses \u2014 much more difficult to obtain by raising the application fee to $100,000. Previously, each application cost\u00a0<a href=\"https:\/\/sites.lawschool.cornell.edu\/path2papers\/resources\/h-1b-visa-and-employment-based-green-card-filing-fees-breakdown\/\" target=\"_blank\" rel=\"noopener\">between $2,000 and $5,000.<\/a><\/p>\n<p>\u201cNo employer is gonna pay $100,000 per worker,\u201d Resek said.<\/p>\n<p>Resek also noted the federal government has paused immigration visas for\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/immigrant-visa-processing-updates-for-nationalities-at-high-risk-of-public-benefits-usage.html\" target=\"_blank\" rel=\"noopener\">75 countries<\/a>. Of those, 19 are subject to\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/12\/restricting-and-limiting-the-entry-of-foreign-nationals-to-protect-the-security-of-the-united-states\/\" target=\"_blank\" rel=\"noopener\">complete visa bans<\/a>.<\/p>\n<p>It\u2019s unclear from available federal data how these policies are impacting the use of work visas in North Dakota. The most\u00a0<a href=\"https:\/\/www.uscis.gov\/tools\/reports-and-studies\/h-1b-employer-data-hub\" target=\"_blank\" rel=\"noopener\">recent statistics<\/a>\u00a0published by the U.S. Immigration and Citizenship Services are from Dec. 31.<\/p>\n<p>As of Dec. 31, the federal government had approved 47 H-1B visas for North Dakota employers during the 2026 federal fiscal year, which started Oct. 1. The biggest visa sponsors were North Dakota State University and the University of North Dakota. Last year, K-12 schools were also another leading employer of H-1B workers in the state.<\/p>\n<p>The federal government approved 358 H-1B visas for North Dakota employers during the previous fiscal year, according to the agency\u2019s website.<\/p>\n<p>Phil Davis, workforce services director for Job Service North Dakota, said he hasn\u2019t seen any decreased demand for H-2A visas, which are for seasonal agricultural workers.<\/p>\n<p>\u201cEvery year, we have seen a 15% to 20% increase in the usage of this program across the state,\u201d he said.<\/p>\n<p>According to U.S. Immigration and Citizenship Services data, there were 109 new H-2A visas approved last year between Oct. 1 and Dec. 31 for North Dakota employers.
