(Photo by Kyle Martin\/For the North Dakota Monitor)<\/figcaption><\/figure><\/figure>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\"col-xxl-1 col-xl-1 col-lg-1 col-md-0 col-sm-0 col-0\">North Dakota Supreme Court Justice Daniel Crothers urged his colleagues to keep the judicial branch impartial as he closed out his 20-year career on the court.<\/div>\n<div><\/div>\n<div class=\"col-xxl-1 col-xl-1 col-lg-1 col-md-0 col-sm-0 col-0\">\u201cMy only words for anyone following are to guard the court\u2019s independence \u2014 guard that fiercely,\u201d he said at a Thursday reception in his honor.<\/div>\n<div id=\"dataContent\" class=\"col-xxl-10 col-xl-10 col-lg-10 col-md-12 col-sm-12 col-12 contentHolder\">\n<p>Crothers retired from the bench on Friday, February 27, 2026.<\/p>\n<p>A Fargo native, Crothers graduated from the University of North Dakota School of Law in 1982. He was a prosecutor for about a year-and-a-half, then went into private practice in commercial litigation, he said.<\/p>\n<p>At the time of his retirement, Crothers was the longest serving justice on the high court.\u00a0 He was first appointed to the bench in 2005 by then-Gov. John Hoeven. Crothers was then elected to fill an unfinished term in 2008, and 10-year terms in 2012 and 2022.<\/p>\n<p>He said he wants the public to understand that the courts work differently than the legislative and executive branches. Judges are supposed to uphold the law, not further any particular political agenda, he said. Crothers said if courts don\u2019t maintain this independence, people\u2019s rights will be at the discretion of lawmakers and the executive branch.<\/p>\n<figure id=\"attachment_17467\" class=\"wp-caption alignleft\" style=\"width: 383px\">\n<p><figure id=\"attachment_17467\" aria-describedby=\"caption-attachment-17467\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-17467\" src=\"https:\/\/northdakotamonitor.com\/wp-content\/uploads\/2026\/02\/Screenshot-2026-02-26-170849-300x200.png\" alt=\"\" width=\"460\" height=\"306\" \/><figcaption id=\"caption-attachment-17467\" class=\"wp-caption-text\">North Dakota Supreme Court Justice Jon Jensen and Chief Justice Lisa Fair McEvers listen to remarks from Justice Douglas Bahr during a retirement reception for Justice Daniel Crothers. (Photo by Mary Steurer\/North Dakota Monitor)<\/figcaption><\/figure><figcaption class=\"wp-caption-text\"><\/figcaption><\/figure>\n<p>\u201cI don\u2019t think we want courts and judges being lap dogs for the political branches,\u201d he said in an interview with the North Dakota Monitor.<\/p>\n<p>He called President Donald Trump\u2019s\u00a0<a href=\"https:\/\/northdakotamonitor.com\/2026\/02\/20\/repub\/us-supreme-court-rules-against-trumps-tariffs-in-6-3-opinion\/\">recent comments disparaging the U.S. Supreme Court<\/a>\u00a0\u201cunfortunate.\u201d Trump accused the six justices who ruled against his tariff policy of caving to political pressure.<\/p>\n<p>\u201cThat\u2019s not helpful to anybody,\u201d Crothers said of the president\u2019s remarks.<\/p>\n<p>During his time on the court, Crothers presented at judicial seminars all across the country and the world, Chief Justice Lisa Fair McEvers said at the Thursday ceremony.<\/p>\n<p>She said he was always willing to lend a listening ear to his fellow justices.<\/p>\n<figure id=\"attachment_17466\" class=\"wp-caption alignright\">\n<p><figure id=\"attachment_17466\" aria-describedby=\"caption-attachment-17466\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-17466 \" src=\"https:\/\/northdakotamonitor.com\/wp-content\/uploads\/2026\/02\/IMG_3211-300x194.jpg\" alt=\"\" width=\"354\" height=\"229\" \/><figcaption id=\"caption-attachment-17466\" class=\"wp-caption-text\">North Dakota Justice Daniel Crothers listens to remarks from his colleagues on the bench during his Feb. 26, 2026, retirement ceremony at the Capitol. (Photo by Mary Steurer\/North Dakota Monitor)<\/figcaption><\/figure><figcaption class=\"wp-caption-text\"><\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cHe is the first person I turn to for advice on ethics,\u201d Fair McEvers said.<\/p>\n<p>Crothers said one of the most impactful cases he heard while on the court was the Legislature\u2019s 2017\u00a0<a href=\"https:\/\/portal.ctrack.ndcourts.gov\/portal\/court\/68f021c4-6a44-4735-9a76-5360b2e8af13\/case\/33f7cbc1-4018-4ff3-86f1-dfe9d0bb8199\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a>\u00a0challenging former Gov. Doug Burgum\u2019s line-item vetoes of several budget bills. The lawsuit led the North Dakota Supreme Court to rule that the governor cannot withdraw vetoes, and that Burgum had issued four of the five vetoes improperly. The court also found that the Legislature could not delegate spending authority to a legislative committee.<\/p>\n<p>The governor and members of the legislative branch were there when the justices heard oral arguments in the case, he said.<\/p>\n<p>\u201cAll three branches were sitting in that courtroom,\u201d Crothers recalled. \u201cIt\u2019s kind of burned into my memory that this is the classic separation of powers, and it was right there in front of me.\u201d<\/p>\n<p>Crothers said there was no particular reason for his retirement, though he said he looks forward to spending more time with family and on his hobbies.<\/p>\n<p>\u201cI have things that I want to get done while I\u2019m still young enough and healthy enough to do it,\u201d he said.<\/p>\n<p>Crothers will be succeeded by Fargo area defense attorney Mark Friese,\u00a0<a href=\"https:\/\/northdakotamonitor.com\/briefs\/fargo-criminal-defense-attorney-mark-friese-appointed-to-north-dakota-supreme-court\/\">who was tapped<\/a>\u00a0for the seat by Gov. Kelly Armstrong earlier this month. Friese will start in the position March 9.<\/p>\n<p>When asked whether he had any advice for Friese, Crothers said no.<\/p>\n<p>\u201cI\u2019ve known Mark for years.
