UND can and should make progress on digital accessibility ahead of new 2027 deadline for updated regulations, coordinator says<\/strong><\/p>\n

On Monday, April 20, the U.S. Department of Justice published\u00a0<\/span>an interim final rule<\/span><\/b><\/a>\u00a0extending the compliance date for new Title II regulations of the Americans with Disabilities Act.<\/span><\/p>\n

These regulations included updated requirements\u00a0and enhanced standards\u00a0to ensure that web content and mobile applications are accessible to people with disabilities.<\/span><\/p>\n

Originally set to take effect on April 26, 2026, for public entities serving populations of 50,000 people or more, the deadline has been extended by one year.<\/span><\/p>\n

Also on\u00a0April 20, Donna Smith, assistant vice president for Civil Rights & Title IX<\/strong><\/a>, issued a message to the campus community with this update.<\/span><\/p>\n

Smith emphasized that UND\u2019s commitment to digital accessibility is unwavering, even as the extension provides more time to work toward compliance.<\/span><\/p>\n

\u201cAccessibility remains a core responsibility, and our progress should not pause or slow,\u201d Smith said.\u00a0\u201cInstead, this extended timeline gives us the opportunity to continue refining our practices, strengthening our infrastructure, and ensuring sustainable, long-term compliance.\u201d<\/span><\/p>\n

Judy Risch, a former member of the U.S. Department of Education\u2019s Office for Civil Rights, now serving as a digital accessibility coordinator for UND, spoke with UND Today to further\u00a0discuss the decision.<\/span><\/p>\n

Notably,\u00a0the legal obligation to provide accessible digital services has long been enshrined in\u00a0the ADA, Risch said.\u00a0The\u00a0extension affects when public entities must meet the Web Content Accessibility Guidelines 2.1 Level A\/AA, specifically.<\/span><\/p>\n

\u201cThe extra time is going to make a big difference, but that doesn\u2019t mean we get to stop,\u201d Risch said. \u201cUND has shown commitment in this regard, in that working to meet Title II\u00a0isn\u2019t\u00a0a one-and-done thing \u2026 This is a push for progress, not perfection.\u201d<\/span><\/p>\n

UND has the means<\/h2>\n

The latest rule from the federal government recognized the constraints of the original timelines, concluding that it overestimated the abilities of state and local governments to comply on time.<\/span><\/p>\n

The Department of Justice cited groups reporting limited budgets, insufficient\u00a0staff\u00a0and lack of technical\u00a0expertise\u00a0to meet the requirements.<\/span><\/p>\n

There was also commentary on the manual nature of accessibility work, as automation through AI or other means\u00a0isn\u2019t\u00a0currently possible.<\/span><\/p>\n

Risch said most points expressed in the interim final rule are immaterial to the progress UND\u00a0can make in the leadup to the new April 26, 2027, deadline.<\/span><\/p>\n

The University has the tools and resources for\u00a0students,\u00a0staff\u00a0and faculty\u00a0to play their part in creating accessible web content, and Risch indicated that more is soon on the way to help with PDF remediation specifically.<\/span><\/p>\n

The campus community can expect further announcements on remediation services this summer.<\/span><\/p>\n

\u201cWe\u2019re surveying faculty, and we surveyed staff this past month,\u201d Risch said. \u201cWe got\u00a0really good\u00a0data that helped drive decision making.\u00a0It\u2019s\u00a0helped us get a sense of the systemic issues affecting campus.\u201d<\/span><\/p>\n

For instance,\u00a0in response to that data,\u00a0the Teaching Transformation & Development Academy\u00a0<\/span>recently held sessions for staff<\/span><\/b><\/a>\u00a0on Microsoft Word, Microsoft Outlook and PDF, as well as a session on the basics of digital accessibility hosted by Risch.\u00a0All session recordings are available to watch.<\/span><\/p>\n

Risch is also seeking people to reach out to her directly if they use Adobe InDesign in their work, as it is a commonly used tool in graphic design that can create accessible material.\u00a0She plans\u00a0to\u00a0organize\u00a0training to help\u00a0address\u00a0this and other high-impact topics and subjects as time goes on.<\/span><\/p>\n

\u201cIf\u00a0people\u00a0have needs and\u00a0those needs are not\u00a0being\u00a0met, please talk to me,\u201d Risch said. \u201cI\u2019ll try to do what I can to address it.\u201d<\/span><\/p>\n

For general information and guidance, the\u00a0<\/span>Accessible UND webpage<\/span><\/b><\/a>\u00a0<\/span><\/b>contains\u00a0links to several digital accessibility topics, from images and PDFs to documents and videos.<\/span><\/p>\n

Everyone has a role to play<\/h2>\n

Risch regarded\u00a0the road to compliance with Title II\u2019s standards as a \u201cmillion-mile journey,\u201d and UND is well on its way.<\/span><\/p>\n

With respect to the federal extension, she said, the voices amplified in that decision were just taking their first steps in the journey.<\/span><\/p>\n

Through her experience with the Department of Education\u2019s enforcement compliance program,\u00a0Risch\u2019s team\u00a0resolved\u00a0thousands of cases on digital accessibility and\u00a0developed\u00a0regulations.<\/span><\/p>\n

\u201cTo me, a lot of the discussion preceding the extension focused on\u00a0the desire for\u00a0quick-fix solutions and easy buttons, and\u00a0those don\u2019t exist,\u201d she said.<\/span><\/p>\n

Shifting focus to UND\u2019s part to play,\u00a0Risch encouraged members of the campus community to\u00a0think about their role, and to think about what they are adding to the web or to a learning management system such as Blackboard.<\/span><\/p>\n

Thinking about\u00a0the backlog of old material can be overwhelming, she added, so\u00a0it\u2019s\u00a0crucial to stop the flow of inaccessible materials being added to UND\u2019s digital presence.<\/span><\/p>\n

\u201cWe\u2019ve talked a lot about scores and percentages, and I look at this more holistically,\u201d Risch said. \u201cI look for progress. We want to take small steps. Campus has started, but have you personally started?<\/span><\/p>\n
