Professor Blake A. Klinkner published the article “When Does a Public Official’s Social Media Activity Constitute ‘State Action’ for First Amendment Purposes?”

The article appears in the June 2024 issue of the Wyoming Lawyer

In his article, Professor Klinkner breaks down recent U.S. Supreme Court caselaw addressing the constitutional rights of public officials to use social media. Professor Klinkner then explains the tests that courts will apply going forward in cases where litigants allege that public officials have violated the First Amendment rights of citizens by engaging in social media censorship or blocking.
